Squishmallows and Build-A-Bear are suing each other!

Both companies have sued the other over their plushes. We are diving into the stuffing and finding out what these lawsuits are all about.

Jazwares, which is the Berkshire Hathaway-owned company that produces Squishmallows, sued Build-A-Bear on Monday, February 12th saying that Build-A-Bear infringed on their intellectual property rights.

Jazwares is taking aim at Build-A-Bear’s line of plushes called SKOOSHERZ™. Jazwares claims the SKOOSHERZ™ are a knockoff of their Squishmallows.

Jazwares stated that Build-A-Bear “blatantly and intentionally undermined its goodwill and created substantial confusion among consumers by copying Squishmallows’ look and feel.” Among the similarities, Jazwares claims that SKOOSHERZ™ had similar “simplified Asian style Kawaii faces, and “velvety velour-like fabric.”

Let’s take a look at some of the SKOOSHERZ™ plushes for comparison:

In return, Build-A-Bear also sued Jazwares on Monday, February 12th. Build-A-Bear claims they have made it clear who produced the SKOOSHERZ™ and that this new line of products are based on their existing plushes.

The SKOOSHERZ™ plushes were launched on National Hug Day (January 21st), in anticipation of Valentine’s Day. Build-A-Bear currently offers 5 different characters on their website.

Only time will tell what happens between these two companies as the face off.
