A lawsuit was filed back in February 2024 that alleged Kanokporn Tangsuan died of anaphylaxis after being served food she was allergic to at Raglan Road, a restaurant at Disney Springs.
The woman’s husband sought damages in excess of $50,000 pursuant to Florida’s Wrongful Death Act, however, Disney is now seeking to get the case dismissed.
According to CNN, Walt Disney Parks and Resorts is trying to get the case dismissed and sent to arbitration because the woman’s husband, Jeffrey Piccolo, signed up for Disney+ years ago.
Back in 2019, Jeffrey Piccolo signed up for a one-month free trial of Disney+ and now Disney is claiming that the lawsuit should be dismissed because of that. When signing up for a trial, users must agree to arbitrate all disputes with the company.
As well, Walt Disney Parks and Resorts also stated that since “Piccolo used the Walt Disney Parks’ website to buy Epcot Center tickets, Disney is shielded from a lawsuit from the estate of Piccolo’s deceased wife, Kanokporn Tangsuan, who died of a reaction to severe food allergies.”
Jeffrey Piccolo’s lawyer, Brian Denney, stated that Disney’s argument “preposterous.” He also stated that it is “so outrageously unreasonable and unfair” that signing up for a Disney+ trial would prevent someone the “right to a jury trial.”
Kanokporn Tangsuan passed away after dining at Raglan Road in Disney Springs on October 5th, 2023. The lawsuit filed stated that Tangsuan and her husband spoke with the waiter and confirmed multiple times that the food that she was being served was free of dairy and nuts. The waiter assured Tangsuan that the items were safe for her to eat, but about 45 minutes later Tangsuan had severe breathing difficulty and collapsed.
An epi-pen was administered, according to court documents, but Tangsuan ultimately died as a local hospital. It was determined by a medical examiner that she died of anaphylaxis due to “elevated levels of dairy and nut in her system,” the lawsuit says.
UPDATE: Disney released an email statement about this response saying, “We are merely defending ourselves against the plaintiff’s attorney’s attempt to include us in their lawsuit against the restaurant.”
