NEWS: Disney World Restaurant Named in Wrongful Death Lawsuit

A new lawsuit alleges that a woman died of anaphylaxis after being served foods she was allergic to at a Disney Springs restaurant.

The woman’s husband is seeking damages in excess of $50,000 under Florida’s wrongful death laws.

According to the lawsuit filed February 22nd in Orange County, medical doctor Kanokporn Tangsuan, her husband Jeffrey Piccolo, and Piccolo’s mother Jackie Piccolo ate dinner at Raglan Road in Disney Springs on October 5th, 2023.

Tangsuan and her husband spoke with their server about Tangsuan’s severe food allergies, and asked whether certain foods on the menu could be made allergen-free, according to the lawsuit. The documents go on to state that the server at Raglan Road went to the kitchen to verify with the chef that the foods could be made without allergens and came back to the table to assure the couple that they could be.

When Tangsuan’s food — which included onion rings, scallops, and broccoli and corn fritters — arrived at the table without allergen-free picks that are typically present in Disney World menu items ordered to be allergy-free, Tangsuan and Piccolo questioned the server once again and were assured the items were safe for Tangsuan to eat, the lawsuit alleges.

After they finished dinner, the trio split up and Tangsuan did some shopping. About 45 minutes later in Planet Hollywood, Tangsuan reportedly began having severe breathing difficulty and collapsed. An epi-pen was administered, according to court documents, but Tangsuan ultimately died at a local hospital. The medical examiner determined that she died of anaphylaxis due to “elevated levels of dairy and nut in her system,” the lawsuit says.

Disney World offers allergy-free menus at the majority of its dining locations, and encourages guests to talk with restaurant staff about their food allergy concerns. The resort has received a Food Allergy Research and Education (FARE) award for “dedication to providing a safe and enjoyable dining experience for vacationing families.”

No answer or further motions have been filed in this case at this time, and no hearings have been set.
